Visier, Inc. (“Visier”, “We”, “Our”, “Us”) is committed to protecting the privacy of your information. We have established this privacy statement to explain how we collect, use, share and secure your personal information as well as the human resources data of our employees. This privacy statement applies to data we collect through the visier.com website, the Visier service platform (“Service Platform”), and other webpages we operate in which we post a direct link to this statement (collectively, the “Sites”). It also describes your choices regarding use, access and correction of your personal information.
EU – US AND SWISS – US PRIVACY SHIELD
Visier participates in and has certified its compliance with the EU – US Privacy Shield and the Swiss – US Privacy Shield Frameworks (collectively, the “Frameworks”). We are committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on the Frameworks to the Frameworks’ applicable Privacy Shield Principles (“Principles”). We are responsible under the Frameworks for the processing of personal data we receive and, in accordance with the Principles regarding onward transfers, the processing of personal data we subsequently transfer to a third party acting as an agent on our behalf. We remain liable, in accordance with these Principles, if our third party agents process such personal information in a manner inconsistent with the Principles, unless we prove we are not responsible for the event giving rise to the damages.
With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, we are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
We have further committed to cooperate with EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU in the context of the employment relationship.
Our customers may electronically submit personal information to us for hosting and processing purposes in connection with a subscription to our products or services (“Customer Data“). We will not review, share, distribute, or reference any Customer Data except as provided in the applicable Visier Subscriber Agreement or as may be required by law. We process Customer Data in our Service Platform under the direction of our customers. We have no direct relationship with the individuals whose personal data are contained in the Customer Data. Our customers are responsible for providing all notices associated with the proper collection of the Customer Data. An individual who seeks to access, correct, amend, or delete their data or withdraw consent to further contact should direct his or her query to the data controller. If the data controller requests that we remove the data associated with an individual, we will respond to the request within 30 days.
INFORMATION WE COLLECT
We do not obtain personal information about you when you visit the Sites unless you choose to voluntarily provide it. Some areas of the Sites request or require personal contact information, such as your name, company name, address, phone number, e-mail address, company annual revenues, number of employees, and industry (“Contact Info“). We do not share your Contact Info with any third party without your consent, except to the limited extent described below under “Disclosure of Collected Information.”
We, and our authorized service providers, may observe your activities, preferences, and transactional data (such as your IP address and browser type) relating to your use of the Sites (“Usage Info“). While we may collect or log Usage Info, we generally do not match this information with your Contact Info.
You may provide us with your personal information, such as that contained on a resume or a curriculum vitae, in connection with a job application or inquiry (“Job Application Info“). We collect Job Application Info to process your application and assess your suitability for a position with Visier, manage your relationship with us, contact you about potentially suitable opportunities, and retain as part of your employment file if you become employed by Visier.
In accordance with the Federal Children’s Online Privacy Protection Act of 1998 (COPPA) and other global data privacy regulations, we will never knowingly request personally identifiable information from anyone under the age of 14. If we learn that we have received information from a child under the age of 14, we will attempt to delete this information as soon as possible. Regardless of any stated preference, we will never knowingly and voluntarily share the personally identifiable information of a child under the age of 14 with a third party.
COOKIES AND OTHER TRACKING TECHNOLOGIES
Cookies on our public websites:
We and our partners use both session ID cookies and persistent cookies and similar technologies to analyze trends, administer our websites, track users’ movements around our websites, and to gather demographic information about our user base as a whole. A session ID cookie expires when you close your browser.
We use session ID cookies on our websites to remember your username for future logins only if requested by you, in which case a persistent cookie remains on your hard drive for an extended period of time. We use persistent cookies to generate usage metrics to better understand the needs of our visitors. We use transient security and authentication cookies to manage your access rights within the Service Platform. These cookies are only valid for the current session and do not persist. Transient cookies are required for the Service Platform to operate.
We gather certain information about you and your activities on the Sites automatically. This information may include your Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring and exit pages, operating system, date and time stamp, and clickstream data.
SOCIAL MEDIA WIDGETS
The Sites include social media features, such as the Facebook Like button and Widgets, such as the Share. This button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy statement of the company providing it.
BLOGS AND FORUMS
The Sites offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. USE OF COLLECTED INFORMATION
We use Contact Info we collect to perform the services requested by the user. For example, if you fill out a “contact me” form, we will use your information to contact you about your interest in our products and services. We may also use Contact Info for marketing purposes. For example, we may use your information to contact you to further discuss your interest in our products and services and to send you information regarding us and our partners, such as information about promotions or events.
We use Usage Info to operate and improve the Sites, to diagnose technical problems with the Sites, to facilitate your use of the Sites, and to track aggregate traffic patterns throughout the Sites. We may also use this information alone or in combination with your Contact Info to provide you with personalized information about our products and services.

Except as described in this privacy statement, we do not share, sell, rent, or trade any of your personal information with third parties for their promotional purposes.
From time to time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share information we collected from you in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of your information. Their use of the information will be in accordance with their own privacy policies. We may transfer your personal information to companies that help us provide our services.
